Terms and Conditions
1. Scope of Application
These Terms and Conditions apply to all contracts concluded between

(hereinafter referred to as the “Artist”)
and customers who purchase artworks via the website
www.izabelakrajnik.com.
The offer is directed exclusively at consumers within the meaning of Section 13 of the German Civil Code (BGB).
2. Conclusion of Contract
(1) The presentation of artworks in the online shop does not constitute a legally binding offer but an invitation to place an order.
(2) By clicking the “Buy now” button, the customer submits a binding offer to conclude a purchase contract.
(3) The contract is concluded once the Artist confirms the order by email or dispatches the goods.
3. Artworks and Products
(1) The following products are offered:
- Original artworks (unique pieces)
- Art prints with an open edition
- Individual commissions and personalized artworks
(2) Due to the individual artistic nature of the works and different screen displays, slight deviations in color, texture, or appearance may occur. Such deviations do not constitute a defect.
4. Prices and Payment Terms
(1) All prices are final prices in euros in accordance with Section 19 of the German VAT Act (small business regulation); VAT is not shown.
(2) Any applicable shipping costs are displayed separately during the ordering process.
(3) The available payment methods are shown in the online shop.
5. Shipping and Delivery
(1) Shipping is carried out nationally and internationally via Deutsche Post or DHL.
(2) Delivery times depend on the respective product and are indicated in the shipping section.
(3) For international deliveries, additional customs duties, taxes, or fees may apply and must be borne by the customer.
6. Retention of Title
The delivered artwork remains the property of the Artist until full payment has been received.
7. Right of Withdrawal
7.1 Right of Withdrawal for Non-Personalized Artworks
Consumers have a statutory right of withdrawal of 14 days for non-personalized artworks and prints.
7.2 Exclusion of the Right of Withdrawal
The right of withdrawal does not apply in particular to:
- individually commissioned or personalized artworks
- goods that are clearly tailored to the customer’s personal preferences
in accordance with Section 312g (2) No. 1 BGB.
8. Commissions and Personalized Art
(1) Commissioned works are created on the basis of individual agreements between the customer and the Artist.
(2) Once the Artist has begun execution or a draft has been approved, cancellation is excluded.
(3) Artistic freedom is expressly reserved. Minor deviations do not constitute a defect.
9. Copyright and Rights of Use
(1) All artworks are protected by copyright law.
(2) The purchase of an artwork does not transfer any rights of use, exploitation, or reproduction.
(3) Without the Artist’s express written consent, the following is prohibited in particular:
- reproduction or duplication
- resale of images or prints
- commercial use
- digital publication or distribution
All copyright remains exclusively with the Artist.
10. Warranty
Statutory warranty rights apply.
Handmade artworks are not considered defective due to minor irregularities characteristic of artistic work.
11. Liability
(1) The Artist is liable without limitation in cases of intent or gross negligence.
(2) In cases of slight negligence, the Artist is liable only for the breach of essential contractual obligations.
(3) Liability for lost profits or indirect damages is excluded to the extent permitted by law.
12. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR):

The Artist is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Final Provisions
(1) The law of the Federal Republic of Germany shall apply.
(2) Should any provision of these Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
